State Supreme Court denies Erwin’s motion for expedited appeal

The Georgia Supreme Court today denied a request to speed up an appeal filed by former House District 28 State Representative Chris Erwin.

Erwin’s attorney Bryan Tyson filed an emergency motion for expedited consideration on Thursday. He asked the high court to speed up its review of a ruling by Superior Court Judge David Sweat. Sweat voided the results of the Dec. 4 Republican special primary election after determining four illegal votes were cast in Habersham County. The ruling removed Erwin from office and left the district without representation.

The Supreme Court unanimously rejected the motion because the case had not been docketed. The justices said at the time there was nothing to expedite.

Erwin’s appeal was docketed hours later. Another motion could be filed.

If Erwin’s attorney asks for and is granted a stay in the case, Erwin could be allowed to return to office pending his appeal.
