The man accused of an attack on Habersham County Recreation Department Director Fenton Morris is now charged with “Battery” and “Disorderly Conduct.”
Danny Roger Canup (on right in photo), was booked at the Habersham County Detention Center yesterday after county officials say he attacked Morris in his office at the Ruby C. Fulbright Aquatic Center.
According to Georgia law, “a person commits the offense of battery when he or she intentionally causes substantial physical harm or visible bodily harm to another.” Which is defined as “bodily harm capable of being perceived by a person other than the victim and may include, but is not limited to, substantially blackened eyes, substantially swollen lips or other facial or body parts, or substantial bruises to body parts.”
Habersham County Manager Phil Sutton explained what happened on Thursday, “Mr. Canup came to Fenton’s office and hit Fenton, then they scuffled.” Sutton says Canup’s wife Diane was a former employee of the department, “Diane was terminated this past fall for hostile work environment issues. She had threatened the recreation department staff.”
Both Morris and Canup were treated for injuries and released from Habersham County Medical Center. Morris returned to work at the Aquatic Center today.
Sutton set in motion a restraining order against Canup and his wife, “they will not be allowed to make contact with the employees at the recreation department,” he says. “Neither Diane nor her husband will be allowed on County property.”
Both charges filed against Mr. Canup are misdemeanors.
