On April 9, voters in Habersham, Stephens, and Banks counties will go to the polls for the third time to elect a state representative for House District 28.
Republicans Dan Gasaway and Chris Erwin are vying for the seat. Gasaway held it for six years, Erwin held it for two weeks before he was forced to vacate it after a judge threw out his election for the second time back in February.
In his ruling, Senior Superior Court Judge David Sweat laid out the guidelines for election officials to follow in conducting the primary redo on April 9.

Who’s eligible?
Only those voters who live within House District 28 and were registered and eligible to vote in the May 22, 2018, General Primary, did not vote, or voted Republican or Nonpartisan may vote on April 9. This includes voters who were previously mis-assigned to House District 10, according to Habersham County Election Supervisor Laurel Ellison.
Voters who moved into or out of House District 28 after May 22, 2018, are not eligible to vote in the April 9 special election.
Those voters whose eligibility was challenged but who remain on the voter rolls will be allowed to cast provisional ballots.
When and where to vote
District-wide, early voting begins March 18 and runs through April 5. Saturday voting is March 30. Habersham County will offer advance voting at its two main precincts April 1-5. Election day is April 9. Absentee ballots are now available upon request.

BANKS COUNTY
In Banks County, voters may cast ballots during early voting (March 18-April 5) from 8 a.m.- 5 p.m. weekdays at the Elections & Voter Registration Office located at 226 Candler Street in Homer.
The office will be open from 9 a.m.-4 p.m. for Saturday voting on March 30.
All of Banks County’s 13 precincts will be open from 7 a.m.-7 p.m. on election day on April 9.
