Former Banks County School Superintendent Chris Erwin says he’s ready to get to work and put the campaigning behind him. He urges Gasaway to do the same.
On Wednesday, State Rep. Dan Gasaway filed a lawsuit seeking a new election in the House District 28 Republican Primary.
He alleges voting irregularities in Habersham, Stephens, and Banks counties may have affected the outcome of the Dec. 4 vote.

It’s the second time Gasaway has sued and, if a judge ends up granting his request, would be the third GOP primary election in House District 28 since May.
A judge sided with Gasaway in the last lawsuit and awarded him a new election after it was revealed that hundreds of Habersham County voters were assigned to the wrong districts.
Gasaway’s opponent, former Banks County School Superintendent Chris Erwin, received the most votes in both primaries. Now Habersham reached out to him for his reaction to this latest legal challenge.
Erwin issued the following statement:
“I am excited and grateful that we are once again victorious. This has been a long process and I am glad it’s finally reached a positive and fair conclusion. Unfortunately, Dan Gasaway has once again decided to file a lawsuit after losing an election. I guess he wants to run this same race for a third time to see if he can finally come out on top.
Dan has served in the House of Representatives for 6 years and hasn’t attempted to address or fix any of his alleged issues with our election process. Much like Stacey Abrams, Dan didn’t tackle the supposed problem when he had a chance. And now like Ms. Abrams, he’s suing after losing an election. My message to both of them is it is time to move on and lets get to work for the people of Georgia.
These lawsuits and special elections cost taxpayers tens of thousands of dollars. It’s a shame we have to foot the bill to satisfy someone’s political ambitions.
With the Legislative Session days away, our District needs to be represented and we deserve a Representative working for us not fighting for themselves. I will push for what is right and I’m looking forward to the hard work ahead serving our community in the State House.”
Now Habersham also reached out to Rep. Gasaway for comment. He referred all questions to his attorney.
No court date has yet been set. Banks County Clerk of Court Tim Harper tells Now Habersham that will “probably be after the first of the year.”
