Chris Erwin remains two votes ahead of House District 28 State Representative Dan Gasaway following a vote recount Tuesday.
Election supervisors in Habersham, Banks, and Stephens counties say none of their vote totals from the Dec. 4 Special Republican Primary changed.
Interim Secretary of State Robyn Crittenden ordered the recount at Gasaway’s request. State law requires a recount be granted if it’s requested in a contest where there’s a less than 1% margin between candidates.
The original vote count in the Dec. 4 primary gave Erwin a three vote lead. After provisional ballots were added, that dropped to two.
Gasaway publicly objected to two of the provisional ballots that were included in the final count in Habersham County. He claims one of the voters doesn’t live in his district and contends that the other is not registered to vote in Habersham.
The three-term incumbent previously said he would wait until the results of the recount to decide whether he would mount another legal challenge.
The nail-biter December election came after Gasaway filed a lawsuit and a judge ordered a redo of the May 22nd Republican Primary. Senior Judge David Sweat ordered the special primary after it was proven that dozens of Habersham Country voters voted in the wrong districts in May. As a result of Gasaway’s legal challenge, more than 400 Habersham County voters were reassigned to their proper districts.
